1. ACCEPTANCE OF TERMS

By accessing or using Budget Pilot AI (“Service,” “App,” or “Platform”), operated by AI Strategy LLC (“Company,” “we,” “us,” or “our”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

2. DESCRIPTION OF SERVICE

Budget Pilot AI is a personal finance management application that provides:

• Budget tracking and management tools
• AI-powered financial coaching and insights
• Expense categorization and analysis
• Financial goal setting and monitoring
• Educational content and recommendations

The Service is provided for informational and educational purposes only and does not constitute professional financial advice.

3. ELIGIBILITY

You must be at least 18 years old to use this Service. By using Budget Pilot AI, you represent and warrant that you:

• Are at least 18 years of age
• Have the legal capacity to enter into these Terms
• Are not prohibited from using the Service under applicable laws

5. USER DATA AND PRIVACY

5.1 Data Collection

By using our Service, you acknowledge that we collect and process your financial and personal data as described in our Privacy Policy. The data is stored solely for the purposes of providing services to you and is deleted from our servers once it has been processed.

5.2 Data Accuracy

You are responsible for ensuring all financial information you provide is accurate and current. Inaccurate data may result in incorrect insights or recommendations. Company is not responsible for any consequences to the user for recording inaccurate data.

5.3 Data Security

We implement industry-standard security measures to protect your data including TLS encryption for data in transit, the Apple Attestation Service to authenticate you, and AES256 encryption for data at rest. However, no method of encrypted transmission over the internet or storage is 100% secure, and we cannot guarantee absolute security.

6. AI COACHING AND FINANCIAL INFORMATION

6.1 Not Financial Advice

The AI coaching, insights, and recommendations provided by Budget Pilot AI are for informational and educational purposes only. They do not constitute:

• Professional financial advice
• Investment recommendations
• Tax advice
• Legal counsel

Before making decisions based on the insights and recommendations provided by the App, we recommend seeking advice from a professional financial advisor or legal counsel. If you choose not to consult professional advice, Company is not responsible for any consequences to the user.

6.2 No Guarantee of Results

We make no guarantees about financial outcomes from using our Service. Financial decisions should be made after consulting with qualified professionals when appropriate.

6.3 AI Limitations

You acknowledge that AI-generated content may contain errors or inaccuracies. Always verify important financial information independently.

7. USER CONDUCT

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Upload malicious code or viruses
• Misrepresent your identity or affiliation
• Use the Service to harm, threaten, or harass others
• Reverse engineer or attempt to extract source code
• Violate any applicable laws or regulations

8. INTELLECTUAL PROPERTY

8.1 Our Property

All content, features, and functionality of Budget Pilot AI, including but not limited to text, graphics, logos, and software, are owned by the Company and protected by intellectual property laws.

8.2 Your License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

8.3 Your Content

You retain ownership of the financial data and information you input into the Service. By using the Service, you grant us a license to process and analyze your data solely to provide and improve our Service.

9. THIRD-PARTY SERVICES

9.1 Financial Institution Connections

If you connect bank accounts or financial institutions, you authorize us to access and retrieve your financial information through third-party services.

9.2 E-Mail Service Connections

If you choose to connect the app to your e-mail service provider to enhance the ability of the app to identify categories of transactions, you authorize us to access and retrieve your e-mail within the App. Your e-mail always stays on your device, and does not flow to any Company server.

9.3 Third-Party Terms

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services or content. Components of the App are provided by Amazon Web Services (https://aws.amazon.com) and by Anthropic Inc. (https://www.anthropic.com, https://www.claude.ai). Please see the respective providers for their terms of service. If you do not wish to comply with the respective terms of service, you must cease use of the App and delete it from your device.

10. FEES AND PAYMENTS

10.1 Subscription Plans

Certain features may require paid subscriptions. Current pricing is displayed in the App and subject to change with notice.

10.2 Billing

By purchasing a subscription, you authorize Apple Inc. to charge your payment method on a recurring basis. You are responsible for keeping payment information current.

10.3 Refunds

Subscription fees are non-refundable except as required by law.

11. DISCLAIMERS

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF INFORMATION

We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, OR GOODWILL
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
• DAMAGES FROM UNAUTHORIZED ACCESS TO YOUR DATA
• DAMAGES EXCEEDING THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS

This limitation applies regardless of the legal theory on which the claim is based.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

14. TERMINATION

14.1 By You

You may terminate your account at any time through account settings or by contacting support.

14.2 By Us

We may suspend or terminate your account for:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Extended periods of inactivity
• Any other reason at our sole discretion

14.3 Effect of Termination

Upon termination:

• Your access to the Service will cease
• We may delete your data after a reasonable period
• Provisions that should survive will remain in effect

15. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of modified Terms.

16. GOVERNING LAW

These Terms are governed by the laws of The Commonwealth of Virginia, without regard to conflict of law principles. You consent to the exclusive jurisdiction of the courts in The Commonwealth of Virginia.

17.1 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with Virginia law.

17.2 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or class arbitrations.

These Terms constitute the entire agreement between you and the Company regarding the Service.

20. SPECIAL PROVISIONS

20.1 California Residents

California residents may have additional rights under California law, including the California Consumer Privacy Act (CCPA).

20.2 EU/EEA Residents

If you are located in the European Union or European Economic Area, additional terms and rights under GDPR may apply. If you use this service in the EU, you are deemed to be a “Data Controller” and as such, provide instructions to and authorize the Company as a “Data Processor” of your potentially personally identifiable information and data. Company may use third party services as “Sub Processors” to process the data on your behalf. Data may be processed by the Processor and Sub Processors within the EU, or within the United States. By using the service, you are explicitly authorizing Company to process your data outside the EU.
